Terms & Conditions

1. General Provisions

These Terms & Conditions govern the use of this online store and the relationship between its customers and “ФИЛОСОФИЯ НА ВКУСА” OOD, UIC 206881704, VAT No. BG206881704, with registered office and address at 8A Abadzhiyska Street, Tsentralen District, 4000 Plovdiv, Republic of Bulgaria, hereinafter referred to as the “Trader”.

By accessing the website, using its functionality or placing an order, you acknowledge that you have read and agree to these Terms & Conditions.

The Trader may update these Terms & Conditions where necessary due to changes in applicable law, the services offered or the operation of the online store. The latest version is always available on this page.

2. Products and Information

The Trader makes reasonable efforts to ensure that information concerning products, including descriptions, images, origin, characteristics, vintage, size and availability, is accurate and up to date.

Product images are illustrative and minor differences in appearance, labelling or packaging may occur without affecting the essential characteristics of the product.

Alcoholic products may only be purchased by persons aged 18 or over. By placing an order containing alcohol, the customer confirms that they meet the applicable legal age requirement. The Trader and/or delivery provider may request proof of age before handing over the order.

3. Orders and Formation of Contract

Customers select the products they wish to purchase and submit an order through the functionality of the online store.

Before submitting an order, the customer has the opportunity to review the selected products, quantities, price, delivery address and other information provided.

Submitting an order constitutes an offer by the customer to purchase the selected products. A sales contract is concluded once the Trader confirms acceptance of the order by email or another explicit confirmation.

The Trader reserves the right to reject or cancel an order where a product is unavailable, an obvious technical or pricing error has occurred, delivery is impossible, there is reasonable suspicion of misuse or another justified reason exists. Any amount already paid for a cancelled order will be refunded where applicable.

4. Prices and Payment

All prices displayed in the online store are stated in the currency indicated on the website and include applicable taxes unless expressly stated otherwise.

Delivery charges and any other applicable additional costs are displayed before the customer submits the final order.

Customers may use the payment methods displayed and available during checkout.

Where an obvious technical error has resulted in an incorrect price being displayed, the Trader is not required to fulfil the order at that incorrect price. The customer will be informed and any payment already made will be refunded where applicable.

5. Shipping and Delivery

Orders are delivered to the destinations and by the methods available through the online store.

Information regarding available shipping methods, estimated delivery times and applicable charges is provided during checkout and/or on the Shipping page.

The Trader makes reasonable efforts to deliver orders within the indicated period. Delays may occur due to circumstances outside the Trader's reasonable control, including courier delays, adverse weather conditions, holiday periods or other exceptional circumstances.

Where possible, customers should inspect packages for visible transport damage upon delivery. If damage is found, customers are encouraged to document it with the courier and notify the Trader as soon as possible.

6. Right of Withdrawal and Returns

Where the customer qualifies as a Consumer under applicable law, the Consumer generally has the right to withdraw from a distance contract within 14 days without giving a reason, unless a statutory exception applies.

For goods, the withdrawal period generally begins on the day on which the Consumer, or a third party designated by the Consumer other than the carrier, receives the goods.

The right of withdrawal does not apply in circumstances expressly excluded by law, including certain goods liable to deteriorate or expire rapidly, personalised goods and other legally excluded categories.

The fact that a product is wine or another alcoholic beverage does not by itself automatically exclude the statutory right of withdrawal. Any applicable exception is subject to the specific requirements established by law.

Full information regarding withdrawal, returns, return costs and refunds is available on the online store's Returns & Refunds page.

7. Complaints and Non-Conforming Goods

Customers may submit a complaint where supplied goods do not conform to the sales contract, including where the wrong product or quantity is supplied, a product is damaged or it does not possess the agreed characteristics.

Consumer complaints are handled in accordance with applicable Bulgarian and European Union consumer legislation.

Where a complaint is justified, the Trader will provide the remedies required by applicable law, which may include bringing the goods into conformity, replacement, a proportionate price reduction or termination of the contract where the relevant legal conditions are satisfied.

Subjective dissatisfaction with taste, aroma or style does not in itself constitute non-conformity where the product corresponds to its description and agreed characteristics.

8. Intellectual Property

The content of the online store, including texts, photographs, images, graphics, design, logos, trade names, databases, software elements and other materials, is protected by applicable intellectual property laws.

Unless content belongs to a third party or otherwise stated, the relevant rights belong to the Trader or are lawfully used by the Trader.

Copying, reproducing, distributing, publishing, modifying or commercially using protected content without the prior permission of the relevant rights holder is prohibited except where permitted by law.

9. Liability and Personal Data

The Trader is not liable for indirect or consequential losses to the extent that such liability may lawfully be limited. Nothing in these Terms & Conditions excludes or restricts mandatory consumer rights or any liability that cannot legally be excluded or limited.

The Trader is not responsible for temporary unavailability of the website resulting from maintenance, third-party service providers, internet connectivity problems or other circumstances outside its reasonable control.

Customers' personal data is processed in accordance with applicable data protection legislation and the Privacy Policy published on the website.

Information about the use of cookies is provided in the online store's Cookie Policy.

10. Governing Law, Disputes and Contact Details

These Terms & Conditions and contracts concluded through the online store are governed by the laws of the Republic of Bulgaria and applicable European Union law.

The parties will seek to resolve disputes amicably wherever possible. Consumers may also contact the Bulgarian Consumer Protection Commission or another competent authority or applicable alternative dispute resolution body. Nothing in these Terms & Conditions restricts the Consumer's right to bring a claim before a competent court.
